Scale Prognostics LLC ("we," "us," or "Company") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what data we collect, how we use it, and your rights regarding that data.

We collect the following categories of information:

• Account information: Email address and name provided during registration.
• Payment information: Billing details processed securely through Stripe. We do not store credit card numbers on our servers.
• API usage logs: Timestamps, endpoints called, response codes, and request volume for rate limiting, debugging, and service improvement.
• Simulation inputs: Battery parameters, cycling profiles, and environmental conditions you submit through the API.

We use the information we collect to:

• Deliver and operate the Service, including running simulations and returning results.
• Process payments and manage your subscription.
• Monitor and enforce rate limits and usage quotas.
• Diagnose technical issues and improve the reliability of the Service.
• Improve our models and products using anonymized, aggregated data.
• Communicate with you about your account, service updates, or policy changes.

We share data with the following third-party services, solely as needed to operate the Service:

• Stripe — Payment processing. Stripe receives your billing information directly and is subject to the Stripe Privacy Policy.
• Railway — Infrastructure hosting. Our API servers run on Railway's platform. Railway processes requests on our behalf and is subject to their Privacy Policy.
• Anthropic — Powers the AI chat assistant on our website. When you interact with the chat widget, your messages are sent to Anthropic's API for response generation. Anthropic processes the data on our behalf and is subject to their Privacy Policy and Commercial Terms. See "AI Assistant Disclosure" below for details.

We do not use third-party analytics or advertising trackers on our website or API.

The chat widget on our website is an AI assistant powered by Anthropic Claude (model: claude-sonnet-4). When relevant, the assistant calls our deterministic battery-degradation engine and returns the simulation results directly. We disclose this in the chat widget header and in the first message of every conversation.

What you should know:

• You are talking to an AI, not a human. The assistant can make mistakes. Verify any quantitative claim before acting on it. If you need a human, email jason@scaleprognostics.com.
• Live simulations are deterministic. When the assistant runs a simulation, the engine output is reproducible — the AI is the interface, not the source of the numbers.
• Conversation handling. Your messages are processed by Anthropic per their commercial API terms. Anthropic does not use commercial API inputs or outputs to train their models by default. We do not retain chat transcripts beyond 30 days and we do not use chat content to train any model.
• What not to share. Do not paste personal health information, regulated data (HIPAA, PCI), trade secrets, or proprietary battery designs into the chat. For sensitive integrations, use the API directly under a signed DPA.
• Opt out. If you don't want to use the AI assistant, simply don't open it. All product features are available without it.

This disclosure is provided for transparency and to align with the FTC's AI guidance, Colorado AI Act (effective 2026), and EU AI Act Article 50 (transparency obligations for AI systems that interact with humans).

We retain your account information and API usage logs for as long as your account is active and for up to 90 days after account deletion.

Simulation inputs are retained for up to 30 days to support debugging and result retrieval, then permanently deleted. Anonymized, aggregated data derived from usage patterns may be retained indefinitely for product improvement.

We do not sell, rent, or trade your personal information to third parties. Period. We do not share your data with third parties for their marketing purposes.

We implement industry-standard security measures to protect your data, including encryption in transit (TLS), secure API key authentication, and access controls on our infrastructure. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Depending on your location, you may have the following rights:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate personal data.
• Deletion: Request deletion of your personal data, subject to legal retention requirements.
• Portability: Request your data in a machine-readable format.
• Opt out: We do not sell personal information, so there is no sale to opt out of.

Our website uses only essential cookies required for authentication and session management. We do not use advertising or tracking cookies.

The Service is not directed at individuals under the age of 18. We do not knowingly collect personal information from children.

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes become effective constitutes acceptance.
