Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Scale Prognostics API and related services (the "Service") provided by Scale Prognostics LLC ("we," "us," or "Company"), a Georgia limited liability company. By accessing or using the Service, you agree to be bound by these Terms.

Scale Prognostics provides a battery degradation prediction API that delivers physics-informed simulation forecasts, including capacity fade projections, resistance growth estimates, and root-cause degradation attribution. The Service is accessed via RESTful API endpoints authenticated with API keys.

To use the Service, you must create an account and obtain an API key. You are responsible for:

• Maintaining the confidentiality of your API key and account credentials.
• All activity that occurs under your account or API key.
• Notifying us immediately at jason@scaleprognostics.com if you believe your API key has been compromised.

You may not share, publish, or expose your API key in client-side code, public repositories, or any publicly accessible location. We reserve the right to revoke API keys that are found to be compromised or misused.

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of the Service.
• Exceed the rate limits or usage quotas associated with your plan.
• Use the Service to build a competing product or service.
• Resell, sublicense, or redistribute API access without prior written consent.
• Transmit malicious code, interfere with the Service's infrastructure, or attempt unauthorized access.
• Use the Service in any manner that violates applicable laws or regulations.

We may throttle, suspend, or terminate access for violations of these terms or usage patterns that degrade the Service for other users.

Paid plans are billed on a monthly subscription basis through Stripe. By subscribing, you authorize us to charge your payment method on file at the beginning of each billing cycle.

• All fees are stated in US dollars and are non-refundable except as required by law.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
• Free tier usage is subject to the limits described on our pricing page and may be modified at our discretion.

Your data is yours. You retain all rights to the input data you submit to the Service, including battery parameters, cycling profiles, and environmental conditions.

Simulation results generated by the Service are provided to you under a perpetual, non-exclusive license for your internal use. We do not claim ownership of your simulation results, but we retain ownership of the underlying models, algorithms, and intellectual property used to generate them.

We may use anonymized, aggregated usage data to improve the Service. We will never sell your individual data or share identifiable information with third parties for marketing purposes.

The Service provides computational predictions and simulation estimates based on electrochemical models. These predictions are estimates, not guarantees. Actual battery degradation depends on real-world conditions that may differ from simulation inputs.

Scale Prognostics LLC shall not be liable for any decisions made or actions taken based on the Service's output. To the maximum extent permitted by law, our total liability for any claim arising from the Service shall not exceed the fees you paid during the twelve (12) months preceding the claim.

We provide the Service "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Either party may terminate this agreement at any time. You may terminate by canceling your subscription and ceasing use of the Service. We may terminate or suspend your access immediately if you violate these Terms or if required by law.

Upon termination, your right to access the Service ceases immediately. We may retain anonymized, aggregated data but will delete your account information within 90 days of termination upon request.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance.

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Georgia.
